Research On Copyright Infringement Of Artificial Intelligence Composition

With the continuous progress of science and technology,artificial intelligence technology based on big data,artificial neural network and in-depth learning is gradually penetrating into all aspects of human production and life.Its application in the field of music is becoming more and more extensive.It can not only provide music materials for human composers,but also independently generate music with great appreciation value.However,it is inevitable to use other people's data in the process of artificial intelligence composition.If it is not authorized,it may infringe the rights of the copyright owner;Music generated by artificial intelligence may also be considered plagiarism because it is substantially similar to data works.From the perspective of copyright,this paper studies the infringement of artificial intelligence composition in stages,identifies the infringement of specific acts of artificial intelligence composition,and puts forward suggestions from the level of system design.This article is divided into five chapters.The first chapter is the introduction,which introduces the writing background and purpose of this article.The second chapter introduces the basic theory of artificial intelligence composition.According to its technical principles,the whole process of composition is divided into three stages:data collection,analysis and learning,and music output.According to practical application,artificial intelligence composition is divided into two categories:auxiliary composition and independent composition.The third chapter defines the specific behaviors in each stage of composition in copyright law,and classifies many behaviors in the process of artificial intelligence composition into two types of behaviors:reproduction and deduction.The fourth chapter identifies the infringement of artificial intelligence composition,demonstrates that the reproduction without the permission of others belongs to the infringement,and the adaptation of other people's works in the deductive behavior does not belong to the infringement,and analyzes the deficiencies of the current copyright law infringement identification standard.The fifth chapter puts forward reasonable suggestions to regulate the infringement of artificial intelligence composition from two aspects of reasonable use judgment and substantial similarity identification.In order to ensure the healthy development of artificial intelligence composition technology and balance the interests of relevant subjects,two conclusions are drawn:the reasonable use identification standard combining convertible use with the "four factors" standard and the "market substitution method" as a supplement to the "contact+substantial similarity"standard.
