Research On The Legal Regulation Of Consultative Administrative Law Enforcement

In the traditional compulsory-mandatory administration,the law enforcement practices of the administrative organs frequently have violent conflicts or even mass violence.Therefore,in the practice of co-administrative law enforcement,the practice of introducing a consultation mechanism into administrative law enforcement has appeared in China The organ communicates with and consults with interested parties in administrative law enforcement.The administrative agency adopts consultative administrative law enforcement to deal with specific matters in its law enforcement activities that enjoy discretion,and conducts communication,communication and negotiation according to the different characteristics of the administrative counterparts and interests.Discuss,exchange,and communicate the matters of administrative decisions.In the end,the administrative organ will make an administrative decision based on the consensus of the two parties,and both parties will perform it in compliance.Administrative agencies apply consultative administrative law enforcement to carry out administrative activities,which can well avoid contradictions and conflicts with administrative counterparts,thereby enhancing the efficiency of administrative law enforcement and achieving the administrative goals pursued by administrative agencies.However,by analyzing the currently applicable law enforcement practice cases,the author finds that the process of using consultative administrative law enforcement to deal with specific administrative affairs in the administrative field also reveals its own defects and specific application of consultative administrative law enforcement.In view of these problems,according to these problems,the actual situation in China is combined with foreign practical experience,and a method for cracking the current plight of consultative administrative law enforcement and the concept of further perfecting it are proposed.It is hoped that the concept of consultative administrative law enforcement will be established in the practice of administrative law enforcement,reducing social instability,resolving contradictions and conflicts in the process of administrative law enforcement,and reducing the cost of administrative law enforcement.
