Empirical Analysis Of The Age Adjustment Of The Minimum Criminal Responsibility In China

The problem of juvenile delinquency has always been a social focus.In recent years,the continuous exposure of vicious juvenile crime cases has caused strong social repercussions,the age of criminal responsibility system has also flooded into the public eye,has been widely discussed and criticized,and the call to reduce the starting point of the age of criminal responsibility has also increased.The academic circles have great differences in this regard,namely the lowering and maintaining the views,the views of the two sides have always been in dispute.This article will start from the theoretical introduction and empirical investigation,explore the direction of the minimum age of criminal responsibility in China,and understand the public's perceptions and suggestions.Clearly adjusting the direction will not only help discover the essential cause of juvenile delinquency,but also point the way for legal improvement.First,start with an overview of the age of criminal responsibility system,and understand the theoretical basis,development history,division theory,value,characteristics,and defects of the age of criminal responsibility system in detail.At the same time,the relationship between the age of criminal responsibility and the capacity of criminal responsibility is explored,and the age division,basis and significance of criminal responsibility in China are introduced.Secondly,detailed the empirical research results of this article,including the summary of literature opinions,the display of questionnaire results and the comparison of interview results,to understand the opinions of different people in various forms.On the basis of full research,this article proposes that the minimum age of criminal responsibility in China should remain unchanged at this stage.It will be more appropriate to discuss the adjustment of the age of criminal responsibility when conditions in the future are available and mature.Finally,while maintaining the minimum age of criminalresponsibility,further suggestions on crime prevention and legal improvement are put forward.Strengthen preventive measures against juvenile delinquency,and strive to find a more appropriate legal system to promote the healthy growth of juveniles.
