A Study On China's Foreign Judicial Cooperation From The Perspective Of Pragmatic Cooperation

No matter in the expression of China's diplomatic discourses,or in the execution of specific cooperation,pragmatic cooperation,or pragmatic spirit,is playing an increasingly important role in contemporary China.It is not only a means to promote cooperation between countries,but also the end itself.In the same light,it is not only a product of the PRC's reform and opening up since 1978,but also has a distant origin and a long-standing foundation in the development of Chinese culture and society.It is precisely because of that can it be closely linked with the diplomatic line of contemporary China and permeates into so many aspects of China's foreign exchanges activities.Owing to that,China has formed a unique cooperation tendency or feature compared to other countries,and foreign judicial cooperation is one of the most important contents.With the connections and exchanges of the people and trade between different countries are becoming closer and more frequently under the background of economic globalization,a great variety of cross-border illegality and criminality are becoming increasingly rampant.That means foreign judicial cooperation which taking punishment of these activities as its fundamental purpose will play a increasingly important role,especially in the process of the international society's transition from an economic community into a community with a shared future.In order to explore the relationship between the practical spirit and China's foreign judicial cooperation activities,this paper will select the judicial cooperation in the field of anti-corruption,fugitive repatriation and asset recovery between China and Canada to concretely expound the embodiment of pragmatic cooperation or pragmatic spirit,and then analyze the significance of this kind of practical cooperation in the judicial field for China-Canada relationship's amelioration or China's diplomacy's advancement as a whole.
