Research On Mechanism Of International Police Cooperation On Oversea Fugitive Repatriation And Asset Recovery

As the fast-growing economy and the multiple ways of international communication, a great number of economic and duty criminal suspects transferred their illegal proceeds and assets to other countries before leaving their own country, leading to national assets loss with adversely international influence. According to the data from National Philosophy and Social Science Planning Project’China Corruption Punishment and Prevention Countermeasures’,4,000 oversea officers have taken away 50 billion USD in the past 30 years. To contain the severe phenomenon, the Ministry of Public Security of the People’s Republic of China commenced the massive ’Fox Hunt 2014’ campaign on July 22,2014 and repatriated 680 oversea fugitives with large illegal proceeds returned by the end of 2014. Meanwhile, our mechanism of international cooperation on oversea fugitive repatriation and asset recovery have been tested in practice, whereas due to the existing unsound fugitive repatriation and asset recovery mechanism, many other suspects still fled abroad with a great loss of illegal proceeds. Therefore, it is a matter of urgency to improve the mechanism of international police cooperation on oversea repatriation and asset recovery.The dissertation is divided into five parts. Part Ⅰ introduces the background of the topic and reviews the literature of mechanism of international police cooperation on oversea fugitive repatriation and asset recovery. It also illustrates the research thought and research methods of this dissertation. Part Ⅱ decodes the concepts of oversea fugitive repatriation, oversea asset recovery and international police cooperation. It also analyses the platform and mechanism of international police cooperation. Part Ⅲ comments on the principles and legislation of the mechanism of international police cooperation on oversea fugitive repatriation and asset recovery, from both nationally and internationally aspects. Part Ⅳ presents the idea of the mechanism of international police cooperation on oversea fugitive repatriation and asset recovery practically, and analyses the network, methods, modes, the flow chart and trend of the cooperation mechanism. Part Ⅴ reasons out the dilemma and the revolution of the international police cooperation mechanism from the social engineering angle. It poses out problems including the incomplete cross-border crimes intelligence and data exchanging system, international crimes evidence collection difficulties, etc. Meanwhile, by considering national situations, foreign affairs relationship, national politices, economy, culture, and military force, it also puts forward suggestions to solve the above problems, such as to establish information sharing mechanism, to strengthen judicial cooperation mechanism of evidence collection, to construct distinctive oversea extradition mechanism, to set up compensations and profits sharing mechanism of confiscating proceeds, and to establish internationally financial crime supervision mechanism.
