With the development and application of artificial intelligence and driverless cars in the future,the legal liability for damage caused by driverless cars will also become increasingly prominent.The existing laws and regulations in our country cannot fully and effectively respond to many legal problems brought about by the future development and application of driverless cars,especially the civil liability for the damage caused by driverless cars.Therefore,it is necessary to analyze the dilemma faced by the civil liability for damage caused by driverless cars,compare the legal liability norms for damage caused by driverless cars outside the region,and combine the current legislative status Legislative development on the issue of loss of legal liability puts forward suggestions for improvement.Driverless cars are different from traditional manned cars and should be treated differently in legislation.First of all,it is necessary to clarify the legal status of driverless cars.Scholars 'opinions are roughly divided into: subject theory,object theory and compromise theory.Self-driving cars cannot leave the realm of things and have legal personality;secondly,due to the special characteristics of self-driving cars,it is difficult to define the subject of responsibility,the original causality is difficult to demonstrate,and the principle of liability cannot be applied.The main body of legal responsibility for the damage caused by unmanned vehicles,that is,the different conditions and basis for the producer,user,seller,and road manager as the main body of responsibility;on this basis,it is necessary to further improve the damage to unmanned vehicles The method of determining the causality in liability,the principle of liability for damage caused by driverless cars in different situations;finally,the relevant regulations of the “dual-track insurance model” and the Tort Liability Law should be applied,that is,to construct the corresponding guarantee system and insurance system,Improve the form of legal liability for damage caused by driverless cars.
