On The Perfection Of Civil Legal Protection Of Minors' Privacy Rights In China

With the development of society,the infringement of minors' privacy has become more and more common,which has caused great harm to the formation of minors' healthy personality.But in our society now for the necessity of the protection of minors' right of privacy has not been given enough attention,the existing system in China despite the special specification of minors' right of privacy and protection,but did not form a harmonious and unified,standardized and orderly system,through prior beforehand prevention,control and so on way to stop the infringement behavior of minors' right of privacy and the consequences of punishment,insufficient minors with complete relief path.Minors' personality is not completely,grow their rights is more vulnerable to abuse,as an important part of personality right and the right of privacy,when this kind of special groups exist in the minors,in most cases,due to a minor privacy protection system is not perfect,so that the protection of the minors' right of privacy is not enough,or even worse,in many cases there are legal blank,ignored the privacy protection of minors.So far,this paper aims to explore the civil protection system of minors' privacy rights in China,and puts forward some Suggestions on how to improve the civil protection system of minors' privacy rights in China and how to protect minors' privacy rights in a more comprehensive way by combining with the corresponding legal system of developed countries region.The content of the first part of this paper is the theoretical basis of minors' right to privacy.First,the concept and function of the generalized right of privacy are introduced,then the concept of minors' right of privacy is summarized,and finally the object of minors' right of privacy is introduced.The right of privacy refers to the right of privacy of personal information and peace of personal life not to be disturbed by others.The second part introduces the manifestation of the behavior of violating the privacy right of minors and the analysis of the causes of the privacy right of minors.The forms of infringement of minors' right of privacy mainly include the infringement of minors' right of privacy in the network environment and the conflict with other rights.As a special group,minors are not fully developed physically and mentally.Compared with adults,when the rights of minors conflict with other rights in some aspects,their rights are more likely to be violated due to the imperfect privacy protection system of minors,and the remedy is more difficult.The third part introduces the protection of minors' privacy right in our country.First of all,it introduces the current stage of China and the laws and local regulations to protect the privacy of minors.Secondly,taking the infringement of minors' privacy in the short video platform as an example,this paper summarizes the current situation of the infringement of minors' privacy in various aspects in China.The fourth part introduces the advanced civil law system of minors' privacy protection in developed countries region,including the overview of the privacy protection system of minors in the European Union,the United States,Chinese Taiwan and other countries and regions.Fifth part through to the relevant regions and countries advanced the reference to the minors' right of privacy protection to both intensify protection of minors' right of privacy in our country civil puts forward some measures and Suggestions,mainly including should enhance the importance of minors' right of privacy,according to the age to the protection of minors' right of privacy to give a more scientific way,coordinate the conflict between privacy and custody,intensify protection of minors of the privacy of network.
