Research On The Legal Issues Of Application And Supervision Of Gene Editing Technology In China

Gene editing technology is a technology to modify gene interior.At present,there are many kinds of gene editing techniques,most of which are plant,mammal and fish.Through gene editing technology,human beings have overcome many physiological diseases and saved many lives.This technology has great significance for human development.But as a science and technology,it has two sides,mainly because since gene editing technology was applied to the human body,it has been opposed by many ethicists and sociologists.Gene editing technology is well known to most people and should originate from the Gene Editing Infant Incident in Guangzhou on November 10,2018.He Jiankui privately carried out human embryo gene editing activities,declaring that it was the world's first gene editing baby immunized with AIDS.They used gene editing technology to create two babies named Lulu and Nana.When the incident was exposed,it caused a great disturbance.Many ethicists and jurists came out against the experiment and pointed out that it was against morality and ethics and ignored human dignity and freedom of life.Later,a special health and committee member criticized this,and Professor He Jiankui himself apologized.But it is unavoidable to ensure that no one is quietly doing the experiment of gene editing technology behind their backs,making gene editing babies,thus affecting human ethics and other aspects of life.Through the research,it is found that the legal problems of the application and supervision of gene editing technology mainly lie in the design of the application legal system of gene editing technology,the imperfect supervision of the application department,the unclear standard legal provisions of the gene editing industry and the inadequate enforcement of the application and supervision law of gene editing technology.In view of the above problems,this paper uses legal thinking and combines the current legislative system of our country.The purpose is to improve the relevant legal system of our country.This paper discusses the legal system of the application and supervision of gene editing technology from four parts.The first part deals with the basic concepts of contemporary gene editing technology,the differences with GM technology and the current status of the development of gene editing.The second part mainly discusses the problems of gene editing technology and analyses them one by one.The third part combines the existing foreign laws and regulations,taking the United States,the United Kingdom and the European Union as examples,respectively,for the implementation of measures of gene editing technology,as a reference for learning.The fourth part,aiming at the problems existing in the application and supervision of gene editing technology in our country,puts forward solutions,so as to strengthen the application and supervision of gene editing technology.Through the constraints of the legal system,as well as laws and regulations,to supervise the correct development and use of science and technology,so as to make gene editing technology serve human better and give full play to the function of gene editing technology to improve human life and improve happiness index.
