Human Gene editing technology has history of nearly 40 years.Since the technology was created,it has attracted the attention of sociology,ethics and legal because it can add,delete or modify gene fragments.He Jiankui's "gene edited-babies" experiment brought the technology back to the forefront in 2018,which was almost caused done-sided opposition and condemnation at home and abroad.The fundamental reason is that technology interferes with human beings themselves.Before the ethical risk caused by technology is completely resolved,it is immoral and illegal to test on the human body by rashly breaking the boundary ethics and law.This paper is divided into five chapters.The first chapter introduces the basic concepts,background,application fields,advantages in disease prevention and treatment,and included disadvantages such as technical risks,ethical risks,social risks and so on.The second chapter discusses the ethical risks caused by human gene editing technology,which will impact human dignity and value,commercialize the value of life,violate generational justice,and promote new eugenics.The third chapter discusses how to balance the value conflict in the legal regulation of ethical risk of human gene editing technology.The purpose of legal regulation is to promote the benign development of the technology and to solve the conflicts of ethical values and legal interests caused by it.The fourth chapter analyzes the legal dilemma of human gene editing technology regulation,combines with the problems and shortcomings exposed by He Jiankui's experiment,and draws on the experience of foreign regulation,in order to put forward some suggestions to improve human gene editing technology in our country.The fifth chapter provides new methods based on the above analysis of our regulatory dilemma.
