Research On The Legal Supervision Function Of Procuratorial Organs In The New Era

The function of legal supervision given to the procuratorial organs by the Constitution is the fundamental attribute of the procuratorial organs' procuratorial power.In recent years,a wave of various reforms has appeared in China.In the "new era" and with the background of judicial system reform,supervision system reform,and trial-centered litigation system reform,procuratorial organs are facing new opportunities to the construction and development of the legal supervision function as well as higher requirements.In the reform of the judicial system,the internal personnel of the procuratorial organs is classified and managed by ratings,and the responsibilities and authority of internal personnel at various levels of positions are specified;The reform of the supervision system transferred from the investigation department of job-related crime puts forward new requirements on how the legal supervision function of the procuratorial organ cooperates with and assists the Supervision Committee in handling and taking over cases;the reform of the trial-centered litigation system has increased the difficulty in handling cases and reviewing evidence for prosecutorial organs.In this case,how to comply with the reform trend,how to seek advantages and avoid disadvantages,how to enhance strengths and avoid weaknesses,and how to strengthen and improve the legal supervision function of procuratorial organs in order to realize the modernization of the legal supervision system and legal supervision functions of procuratorial organs have become the focus to the central government,the media,and the masses and are worthy of further study.The article takes the S District Procuratorate as an example,using the relevant knowledge and principles of public management and based on the new requirements imposed on the legal supervision function of China's procuratorate by the reform practice of current judicial system,supervision system,and litigation system;conducts research using methods comprehensively such as literature research,society research and case studies to explore the problems and causes;takes as the top priority how to improve the existing legal supervision system,how to optimize the internal organizational structure of the procuratorial organ,how to reform the operation system of the internal organs,and how to match the functions of the procuratorial organs to stabilize and strengthen the legal supervision function of the procuratorial organ in China;explores the countermeasures and methods for reform.The countermeasures to strengthen the legal supervision function of the procuratorial organs aremainly put forward from the following aspects: the first is to improve the legal supervision system of the procuratorial organs;the second is to improve the operating mechanism of the internal supervision organizations of the procuratorial organs;the third is to develop the function matching forms of procuratorial organs;the forth is to establish a procuratorial working mechanism that is compatible with the supervisory organs,to fully cooperate with the work of Supervisory Committee to achieve efficient convergence,to promote the legal supervision function of the procuratorial organs comprehensively through system construction and organizational reform,to create new highlights of the procuratorial organs,and to ensure that the procuratorial organs conform to the reform of the new era in order to strengthen the construction and development of their authority.
