Analysis On The Problems Existed In Quality Supervision Punishments And Corresponding Solutions

With the economic and social development, the influences and activities of the quality supervision administrations have expanded greatly. According to the function that quality supervision administrations supervise the products from their sources, the influences of the quality supervision administrations have involved almost every aspect of our social life now. Therefore, whether the quality supervision administrations exert their rights lawfully or not is directly related to the legal benefits of the citizens, corporations and other organizations. Once exerting their rights wrongly or against the laws, the quality supervision administrations will definitely impair the benefits of the citizens and the corporations.This thesis has mainly discussed the problems existed in current quality supervision punishments, including problems like the random use of the laws and regulations, the function overlaps with other departments, the disharmony between the quality supervision administrations and the administrative subjects, etc. The author thus analyzes the reasons of the problems from the points of views of the legislation, administrative main body, administrative procedures, law environment, theories of the administrative execution and the supervision system. Then the author puts forward some tentative ideas to solve these problems. Through the thinking of the solutions to these problems, the author aims to provide some thoughts to the quality supervision administrations on how to exert administrative punishments correctly, timely and effectively. Meanwhile, the author hopes that the thesis has some active effects on safeguarding the legal benefits of the administrative subjects, and realizing real lawful administration in the end.
