With the deepening and continuation of the process regarding economic globalization,trademark piracy continues to emerge in many countries around the world.How to deal with trademark piracy is an important part of the global strategy regarding brand owners' intellectual property rights.Brand owners,especially those multinational corporations,have invested multitudinous material and human resources in dealing with trademark piracy,which could not always result in the most desirable outcome at the end.Trademark piracy has even become an important constraint on the development of multinational corporation brand globalization strategy.In short,trademark piracy means,without getting the approval from the brand holder,applying or registering the domestic and overseas trademarks which are the same or similar to those of the brand owner,stealing the goodwill of the brand owner or otherwise profiting from the brand owner.Many multinational corporations have encountered trademark piracy problems when entering into Chinese market,for instance,trademark disputes between TESLA and Zhan Baosheng.This article first introduces the cause and present situation of trademark piracy,then elaborates the response mechanisms of trademark piracy and the guideline for the evidences in practice,and finally throws out some immature suggestions for the regulation of trademark piracy.
