| Because of the various differences like historical,cultural,economic backgrounds and factors,the tort of law and conflict of law are quite different in various countries.Thus so many conflicts between various legislations are produced,and the application of the legal responsibility about road accidents involving foreign parties as well.The treatment of this special infringement case is related to the interests of involving parties,and also has a significant influence on the social order and public interests of a country.Further more,it is refer to the realization of fairness and justice.Since the lack of legislations and the shortage of judicature,Chinese citizens cannot protect their rights and interests forcefully when they run into road accidents in foreign,and usually they are in the negative position.Therefore,it is very important to improve Chinese application of foreign-related legal.The full text is divided into four parts:In the first part,investigate the concept and characteristics of foreign-related road traffic accident infringement,existing legal conflicts,and laws applicable rules.In the second part,analyze by case of the status quo of China's foreign-related road traffic accident infringement,by combing China's current relevant legal system,as well as judicial practice cases and data analysis,summarize the current status of legislation and justice about this problem in China.In the third part,On the basis of the analysis of the status quo,we will discuss the main problems in the application of the law of infringement of road traffic accidents in China.In the last part,clarify the value pursuit that China's private international law should adhere to,propose perfect suggestions for application of the law of infringement of road traffic accidents. |
