Since the reform and opening up,the process of industrialization in our country has been accelerating, which has promoted the pace of urbanization in China. In the past 30 years, the urbanization rate in China has been growing steadily and rapidly. The number of cities and urban population and scale have expanded rapidly. The urbanization level of permanent residents has increased from 17.92%in 1978 to 51.27%in 2015.At the same time,as the establishment of China's household contract responsibility system for joint production has greatly promoted the development of agricultural productivity and greatly increased agricultural productivity, the substantial increase in agricultural productivity has also created a huge rural surplus labor force, and a large influx of rural surplus labor force.Agricultural industry and city. The surplus rural labor force is what people call "migrant workers".Due to the limitations of its own cultural quality and skill level, migrant workers can usually only engage in industries with a relatively poor operating environment and a relatively high risk.Coupled with the lack of self-protection awareness,a large proportion of migrant workers are seriously threatened by occupational diseases.Pneumoconiosis is the largest and most serious disease in many occupational diseases in China. At present, more than 590,000 pneumoconiosis patients have been reported in the country.About 10,000 new pneumoconiosis cases are reported each year,of which more than 90%are migrant workers.Occupational diseases seriously endanger the health of migrant workers, and can greatly hinder their lives and work.In this regard,China has specifically introduced laws to protect the rights of migrant workers against occupational diseases, and can provide protection for migrant workers. However, migrant workers have had difficulties in protecting their rights after suffering from occupational diseases. They have not signed labor contracts,do not know where to go for rights protection, and do not know how to defend their rights.Based on this, this paper selects typical cases that have occurred in recent years.Through the study of cases, this paper discusses the difficulties and difficulties in the occupational disease protection of peasant workers and the countermeasures. The purpose is to make every effort to promote awareness of rights protection for migrant workers and protect the legitimate rights and interests of migrant workers.
