With the advancement of industrialization and the development of occupational disease prevention and treatment work,China has gradually established a legal security system with the Occupational Disease Prevention and Treatment Act as its core and a medical security system with Occupational Disease Prevention and Treatment Center as its core to protect workers' occupational health rights.Corresponding to the gradual improvement of systems and technologies,there should be a gradual improvement in the effectiveness of prevention and treatment.However,the number of cases of occupational diseases reported every year has steadily increased and mass incidents caused by rights protection for occupational disease occur frequently,which reflects that the current occupational disease prevention and treatment work still faces enormous challenges.Therefore,whether it is out of the humanistic concern for the bottom society or to promote the harmony and stability of the whole society,it is an important and meaningful research topic to research the situation,strategies and ethics of the occupational disease workers.This study is based on thetheory of state governance and the underlying action theory.It follows the logical framework of “regulation-response”.From the perspective of the bottom occupationaldisease workers,the author examines the micro-influence of the national system design on individual workers,in order to find the existing problems in current occupational diseases prevention and treatment system,to study the actions taken by the sick workers in the absence of institutional supply;and to discuss the cultural and ethical characteristics behind complex action strategies.On the basis of field survey,the following conclusions are reached.Firstly,the omission and distortion of information,local despotism and the weakening of social support make it difficult for sick workers to protect their rights and interests through institutional empowerment.Secondly,when the system can not fully protect the rights and interests of workers with occupational diseases,the workers will take a "hybrid strategy" in order to obtain an equal status in the course of the game.Thirdly,the actions of workers with occupational diseases reflect a solidarity culture based on “social identity”.Social identity is the core of workers' actions and strategy transformation.Based on the above conclusions,this study believes that in order to raise the level of prevention and treatment of occupational diseases in our country,first of all,it is necessary to rationally groom the economic development pressure of the grass-roots government and reasonably position the government's role and responsibility in the labor-capital conflict;secondly,it is important to increase the institutional support for workers with occupational diseases,thus to balance workers' weak status in the labor-capital game;and at last but not the least,the workers themselves need to increase their degree of organization and expand their scope of solidarity,and promote the construction of the entire system through explicit and powerful expression of their interests and rights.
