| The purpose of the practical exploration of the separation of three rights in the house site is to fully explore the property attributes of the house site and increase the income of farmers’ property to promote the implementation of the rural revitalization strategy.However,the lack of legal rules on the qualification of homesteads in China has caused many problems in research and practice.The first is insufficient information construction in the field of homestead management.The second is the development of homestead eligibility rights is limited by the existing household registration system.Third,most peasant households don’t pay attention to the right to eligibility,but rather pay more attention to the real right to dispose of their own homestead and house ownership.Under the current system of laws and regulations and regulatory rules,it is more difficult to legally regulate the right to a homestead.First,neither the theoretical practical circles in China have formed a unified and mature understanding of the right to a homestead.The second is there is no special law on house sites,and supervision system for the practice of the right to house sites has yet to be improved.In order to give full play to the role of the homestead as an important property,protect the farmers ’right to live while increasing farmers’ income and promote the implementation of the "village revitalization" strategy.It is suggested that after full practice,the overall legal system of "three-right separation"of homesteads should be established,and the clear provisions for the right to homestead qualifications should be improved;Link up with the work of household registration reform,and take into account the guarantee attributes of the right to homestead qualifications and the property attributes of increasing the right to homestead qualifications.Only by correctly understanding the central spirit,respecting the practice and actively reforming the results,and doing a good job in the details can we advance the legal system of qualifications. |
