Research On The Legal Issues Of Administrative Litigation For The Disclosure Of Government Information

The government information disclosure administrative litigation is a special administrative litigation based on the government information disclosure system.On May 15,2019,the newly revised regulations of the People's Republic of China on the disclosure of government information(hereinafter referred to as the regulations)came into force,further improving the government information disclosure system in China.The government information publicity system of administrative litigation is the basis of the government information publicity system,using legal means to safeguard the public's right to know administrative litigation system,is a citizen,legal person,other organization in the constitutional framework,through legal weapons to exercise their rights to obtain the required government information of the judicial relief way,is conducive to the implementation of the citizens' constitutional right,plays an important role in the supervision and administration institution to make administrative action,and conform to build a service-oriented government and to strengthen the cultivation of clean government of intrinsic value.With the gradual strengthening of Chinese citizens' legal consciousness,it has become a common social consensus to use legal weapons to safeguard their legitimate rights and interests,and the difficulty of "civil prosecution" that has been troubling ordinary citizens has been solved to some extent with the establishment and gradual improvement of the administrative litigation system of government information disclosure.The government information disclosure administrative litigation is a special type of administrative litigation based on the government information disclosure system.The information disclosure applicant can obtain the government information he needs and can or should know through the government information disclosure administrative litigation.The purpose of establishing the administrative litigation system of government information disclosure is to safeguard citizens' right to know,and at the same time,it plays a profound supervisory role in the construction of law-based government and the implementation of law-based administration.Due to the short time for the formation and establishment of this system in China,the supporting laws and regulations system is not perfect,and many problems are difficult to be properly solved in judicial practice.Based on this,it is still necessary to conduct a more in-depth study on the administrative litigation system of government information disclosure.This paper,based on the purpose of establishing the system,combined with the prominent problems in judicial practice,and compared with the advanced system design outside the region,analyzes all kinds of difficulties under China's current system,and seeks reasonable solutions to relevant problem...
