Astudy On The Abuse Of Litigation Rights In Government In Formation Disclosure

In 2008 on the implementation of the government information disclosure regulations of the People’s Republic of China(hereinafter referred to as the regulations),as China’s first government information publicity system specification,for all parts of the country in accordance with the law has provided the basic follow the government information disclosure work,in the protection of the public’s right to know,service life and effective economic and social activities.However,the implementation of the regulations has been faced with various problems and challenges.For example,in the implementation of the regulations in Guangdong province,the number of government information disclosure litigation cases has been increasing year by year,and the abuse of government information disclosure litigation rights has been increasingly prominent,seriously damaging the seriousness of laws and regulations,disrupting the order of government information disclosure,and affecting the effective allocation of public resources.Therefore,from the perspective of Guangdong province,this paper studies and analyzes the causes and effects of the abuse of litigation rights in government information disclosure,and puts forward countermeasures and Suggestions to curb the abuse of litigation rights in government information disclosure from the perspective of administrative organs and from the level of perfecting the government information disclosure system.This paper is divided into seven chapters.The first chapter is the introduction,which shows the research background,significance,current situation,ideas,methods,contents and innovative points.The second chapter introduces the concepts and theoretical basis of government information disclosure,including the meaning of government information,government information disclosure,government information disclosure system and government information disclosure litigation,as well as therelated theories of people’s sovereignty,new public service theory,limited rights theory and balance theory.Chapter three,through full and accurate data,objectively reflects the status quo and development trend of the application and litigation of the government information disclosure in Guangdong Province from 2015 to 2017,and introduces the basic facts of the typical cases of the government information disclosure litigation in recent years.The Fourth Chapter summarizes the causes and adverse effects of the government information disclosure litigation.The fifth chapter introduces the construction and exploration of government information disclosure system at home and abroad.The sixth chapter puts forward countermeasures and Suggestions to curb the abuse of government information disclosure litigation rights.Chapter seven is the conclusion and prospect.
