The Research Of The Legal Issues Of Ship Design On Ship Construction

The ship construction is a complex project,which has the characteristics of the large amount of investment,the long project cycle and the sophisticate technique.The ship design plays the key role and perform throughtout the life of the ship construction.A deficient design may result in defect in any part of the ship.During the project perod,the design is not constant,but changes with the specification.This paper starts with the ship construction contract and make the definition of the ship design specification,which is working as the carrier of the details of the ship design and has the equal authentication of the contract.As for the legal issues of the ship design,this article is devided into two parallel timeline.First,we study the legal risk of ship design in the entire building progress and find out the corresponding solution.The design modification is also working along with entire progress,so the next step we conclude the design related issues and try to find a way out by introduce the analysis of legal period which is widely used in the field of land foundation engineering.In the end,we make a further study about the lability subject,the scope of liability and the form of assume liability.Research methods adopted by this paper are mainly case analysis,criterion analysis and comparative analysis.British laws are commonly used in practical cases,so after analyzing the agreement of contract,this paper also gives attention to the relevant British laws and regulations and analyzes the relevant English cases as well.Through a thorough comparsion of its application situation between the British laws and Chinese laws,it's found that the description of quality flaw in Chinese law is not clear enough.It requires the joint effort with contract terms so as to play a better protective role.Therefore,in terms of the legal risks existing in the design of ship,both the contract terms and the applicable laws should be taken into consideration to choose appropriate strategies and to realize the purpose of contracts.
