Research On Legal Problem Of The International Ship Registry

At present the current three classification of ship registration system,which can be roughly divided into strict registration,open and half open registration.Traditional ship registration system in our country belongs to the strict registration,which have strictly requirements on the owner of the ship,the ship operating conditions and the crew strictly requirements.Although,to a certain extent,this system ensure the interests of navigation safety and the supervision and management,but at the same time also makes the crew of the owner burden high labor and related taxes and fees,and affect the choice of the nationality that the owner of the ship,make a lot of Chinese ship choose to open registration,become a convenient flag ship,this to the development of shipping industry in our country has many negative influence.International ship register system is a kind of both different from the traditional system of strict registration,which is also different from the open registration system,some scholars call it half open registration system.The system can be said to be the response to the formation of the flag of convenience product of ship impact,its characteristic is in conflict with the original ship registration system is not under the premise of relaxation in the certain scope and degree of ship registration conditions,reduce or exempt from some taxes,so as to reduce the owner's operating costs,in order to attract their ships moved back home.At present,our country is in the shipping country to the development of the shipping power transition,whether in theory or practice,improvement measures are actively research and practice,deal with convenient flag vessel growing on the impact of the shipping industry.This paper is divided into four chapters:the first chapter is an overview,including the definition of international ship registration system,with the contrast between the openness of ship registration and strict,and the development process of the system,highlights the nature and characteristics of system.The second chapter is our country implements the necessity of the international ship registration system analysis,points out the inherent restriction of traditional way to register in our country,in order to solve the convenient flag ship to shipping industry to bring the huge impact,in learning the successful experience of other shipping power,and its own inefficiency of a series of improvement measures,such as reason,choose to implement international ship register system is very necessary.The third chapter mainly introduces the international ship register system in the pilot implementation of Shanghai free trade zone,mainly focused on the specific laws,regulations and policies of the implementation of free trade zone in Shanghai were analyzed,and pointed out that the system for the innovation of the Chinese traditional system,and its deficiency in practice to implement.The fourth chapter in view of the above international ship register system problems found during the trial in Shanghai free trade zone,put forward his own Suggestions,including Shanghai free trade area of the ship registration regulations are formulated,reducing taxes and fees standard,further simplified the ship registration procedure and its single ship financing lease company capital.
