Study On The System Of Heritage Administrator In China

The system of heritage administrator is an important legal system to manage and dispose heritage.In our country,there are 16 and 24 articles in the inheritance law that stipulate the executor.Article 44 of the opinions on Inheritance Law stipulates the principle of the custodian of heritage.However,at this stage,there is no clear legislation on the system of heritage administrator in China.The civil code of the people’s Republic of China was formally adopted on May 27,and articles 1145-1149 of the fourth chapter of the code of succession stipulate the selection,duty,responsibility and remuneration of the administrator.According to the provisions of the system of the administrator of the heritage in the civil code,this paper discusses the construction and improvement of the system of the administrator of the heritage in detail.It is a great progress of our country’s heritage management system that the civil code writes the system of heritage administrator into the code of succession.In today’s society,with the rapid development of economy and the continuous increase of personal wealth,the types,quantity and value of heritage increase.However,the inheritance law of our country has not been changed for more than 30 years,which has been unable to meet the development of the contemporary society,and can not better deal with more and more complex heritage disputes.Many experts and scholars have been looking forward to building a heritage administrator system in line with China’s economic and social development.In civil code,the system of administrator of heritage is written into the code of succession,which is conducive to better settlement of heritage disputes and protection of the interests of heritage stakeholders.This article will take our country’s heritage administrator system as the research object.Combined with the current legal system of our country,this paper studies the system of the administrator of the heritage in our country from the chapter of the inheritance of the civil code.In order to build a perfect heritage administrator system,this paper will be divided into four chapters.The first chapter is an overview of the administrator system.This paper discusses the Connotation of the heritage administrator system,and compares and analyzes the heritage administrator system with other related heritage disposal systems.Each heritage management system is analyzed briefly,and the reason why heritage manager system is superior to other systems is concluded.It also discusses the value of heritage administrator system and the characteristics of heritage administrator.The second chapter discusses the current situation of the legislation of heritage administrator system in China.This paper analyzes the advantages and disadvantages of the establishment of heritage administrator system in the civil code.The third chapter discusses.the practical problems in the system of heritage administrator.In the fourth chapter,according to the heritage administrator system of the civil code of China,combined with the heritage administrator system of other countries,the author puts forward legislative suggestions.We should strive to make the heritage administrator system in line with China’s national conditions,which is conducive to further implementation,to solve the frequent phenomenon of heritage disputes in today’s society,to protect the interests of heritage stakeholders,and to maintain social stability and order.
