Research On Food Safety Liability Insurance Legal Improvement

The food safety liability insurance legal system is the general term for the legal norms to adjust the relationship between food safety liability insurance.The legal system intervenes in the food safety liability insurance relationship and corrects market failures,which can ultimately guarantee food safety victims access to relief,improve food safety supervision efficiency,reduce food safety risks,and stabilize social order.There are legal loopholes in China's current food safety liability insurance legal system,which leads to insufficient intervention in the relationship of food safety liability insurance.The paper analyzes the legislative dilemma of China's food safety liability insurance legal system based on market defect theory and national intervention theory.And it concludes the key points for the improvement of China's food safety liability insurance legal system are the four aspects of the insurance behavior norms,rate determination norms,exemption clause norms and liability scope norms.Based on the practice of domestic and international food safety liability insurance legislation,this paper put forward several suggestions from the basic concept,the overall idea and the specific content of three aspects,in order to improve China's food safety liability insurance legal system.
