Research On China's Food Safety Liability Compulsory Insurance System

Food is a necessity to support human life and health,so food safety is a prerequisite for our health.However,in recent years,there have been a lot of food safety accidents,and the victims are usually unable to obtain corresponding compensation and damage the rights and interests of the victims.The illegal food enterprises may face bankruptcy and increase the financial burden of the government because of the huge amount of compensation.This kind of phenomenon has jeopardize the harmony and stability of the whole society.It is against this background that we study the construction of food safety liability compulsory insurance,which has the function of dispersing risk for the food production enterprises,transferring the liability of compensation,reducing the government's liability for compensation,and enabling the victims to get effective compensation.Therefore,in the field of food safety,the implementation of compulsory insurance for the responsibility of food safety is an effective way to solve the above problems.In order to construct the compulsory insurance for the responsibility of food safety as the center,the study is divided into four parts in the perspective of theory and practice.First,a summary of the compulsory insurance for the liability for food safety.The concept and characteristics of food safety liability insurance and food safety liability compulsory insurance are summarized.It also expounds the theoretical basis for the establishment of compulsory insurance for the responsibility of food safety,including the theory of risk society,the theory of fair and justice,the theory of cost and benefit and so on.Second,demonstrate the necessity and feasibility of the development of the compulsory insurance system for the responsibility of food safety in China.The enforcement of responsibility for food safety can make consumers get compensation,reduce the government's financial expenditure and disperse the risk of food production enterprises.Therefore,it is necessary to implement the insurance in our country.From the perspective of food safety liability compulsory insurance certificate,traffic compulsory insurance experience,insurance underwriting capacity,pilot experience of"liability insurance",and "food liability insurance" policy support,the feasibility of constructing food safety liability compulsory insurance in China is analyzed.Third,analysis of the Taiwan area of China's food safety liability insurance and foreign product liability insurance formulation content and supporting system.The foreign countries mainly analyzed the product liability insurance of Japan and the United States and the European Union food safety liability insurance.The domestic and foreign food safety liability insurance has enlightens our country to implement the compulsory insurance system of food safety responsibility in the food industry.The enlightenment to our country is to strengthen the punishment to the illegal enterprises,to establish the related auxiliary system,to improve the consciousness of the people's Insurance and to protect the rights of the people.Fourth,construction and improvement of the compulsory insurance system for the responsibility of food safety.The design of the system includes the improvement of legislation,the definition of basic principles,the determination of insurance and underwriting subjects,the determination of insurance scope,the determination of rates,and the determination of legal responsibilities.And the establishment of a supporting system for the compulsory insurance system for food safety.Suggestions for follow-up development include strengthening publicity and establishing a rescue fund.
