There is no doubt that modern society puts information first and operates with information as the center.All kinds of communication and cooperation from the public field to the private field depend on the circulation of information.Obviously,information maintains an unshakable importance in maintaining social operation.In fact,every individual is a huge information base,which is the source of many important information.As an independent individual,personal information gradually shows great value in the interconnected Internet era.In recent years,the development trend of artificial intelligence is increasing day by day,all kinds of technologies are frequently innovated,and the application of artificial intelligence is gradually developed.In particular,the application of face recognition technology has rapidly spread from the public domain to the private sector of the economic society.Under the situation of the popularization of face recognition application,how to ensure that this technology can effectively help the development of society and prevent the resulting risks needs to be regulated by law.If the application of artificial intelligence and face recognition technology brings conflicts,it is also required by the rule of law to find clear rules in the law to deal with the corresponding civil relations effectively.The purpose of this paper is to clarify the legal issues involved in face recognition technology,to explore whether the problems caused by the technology can be effectively remedied according to the existing legal norms,and to focus on the legal issues of biometric information generated by the technology,to explore the feasible protection path for the face recognition industry and biometric information,and to put forward the feasible protection path.In addition to the introduction,this text mainly includes three parts.The first part is an overview of face recognition technology.This paper briefly introduces the workflow,characteristics and application scenarios of face recognition technology,and analyzes the particularity of face recognition information,which is the core of this technology.At the same time,this paper combs the different opinions about the application of this technology in domestic and foreign markets,which support the promotion and worry about the invasion of privacy,summarizes the security risks of face recognition technology,and points out that it is the social demand to regulate face recognition in order to balance the application of technology and personal interests.At the same time,this paper combs the different opinions about the application of this technology in domestic and foreign markets,summarizes the security risks of face recognition technology,and points out that it is the social demand to regulate face recognition in order to balance the application of technology and personal interests.The second part analyzes the legal issues involved through some application cases related to face recognition technology.Last year,a face-changing software named Zao was popular in China,but it disappeared immediately,including the infringement of portrait right,copyright and even reputation right.The configuration of intelligent monitoring equipment in public places is widely and increasingly questioned by privacy issues.These rights are based on existing legal norms,and remedies can be sought in case of disputes.The first case of face recognition,which is based on the illegal collection of biometric information,has a profound significance in the field of information security.Therefore,the application boundary of face recognition is hotly discussed,reaching a moment when legislative regulation is required.Finally,this part summarizes the applicable space and shortcomings of face recognition technology risks under the existing legal framework in ChinaThe third part draws on the foreign legal system,explores from the consent principle of risk prevention,the clarification of rights and obligations,the path of tort relief,various supervision systems and the mode of industry self-discipline.Put forward the prospect of future legal regulation,connect the new problems brought by face recognition technology with the existing laws,pay attention to the protection of biometric information,and realize the economic development of face recognition technology within the limits of protecting personal information and personal privacy reasonable utilization through the joint governance of civil law path,criminal law and administrative law.
