Abstract/Summary:
In recent years,face recognition technology has been vigorously promoted,which can be seen in banks,canteens,supermarkets,subways,convenience stores and other places.However,in the face recognition technology used by operators,there are also problems that infringe on the safety of consumer face information.Specifically,it includes: the face information of consumers is illegally collected and used,and there is a great risk of leakage in the storage of face information.Therefore,it is urgent to protect the face information of consumers.Through the analysis of the current personal information protection norms,it is found that: first,the classification of personal information is mixed in legislation and the special legislative protection of face information is insufficient;second,the disclosure and consent rules can not provide effective protection for consumers’ face information;third,the private law remedies for the protection of privacy and property rights fail.In this regard,we should emphasize the control of operators’ use of face recognition technology to avoid the operation of technology out of law,so as to meet the needs of consumers’ face information protection.In the case of insufficient protection of the existing legal framework,a joint force of protection should be formed from the following approaches: first,strengthen the legislative protection by improving the relevant separate legislation and enacting the personal biometric information protection law;second,realize the protection of face information by "express consent rules" and "prohibition processing rules";third,strengthen the administrative supervision of face information Legal protection;fourthly,the self-discipline mechanism of operators is generated through the industry self-discipline norms and the internal compliance use mechanism of enterprises;fifthly,the personal protection awareness of consumers is strengthened.
