The Copyright Research of AI composing refers specifically to whether music works created by AI composing can be copyrighted or not.With the development of science and technology,the third wave of artificial intelligence comes.It has been called the fourth industrial revolution.All aspects of production and life have changed dramatically under its promotion.At the same time,the emergence of composing artificial intelligence pushes the field of culture and art to a climax.However,the birth of new things will surely impact the existing human world.The birth of artificial intelligence technology will impact the existing order just like the arrival of all new technologies.How to deal with such challenges is both a dilemma and an opportunity.It is wise to change the existing state in response to new events,but the legal world is all about change,so change is bound to be a battle.Artificial Intelligence(AI)brings the power of change outside the law to lead human progress towards a better future,but at the same time,it is a force of change within the law.It not only solidifies the system,allocates rights and obligations,balances the interests of all parties,but also restarts from the beginning.It is both an opportunity and a challenge.Composition AI has always been the most dazzling branch of AI,and it is also a widely studied area in the field of AI.At this stage,the development of AI for composing has shown a diversified trend,and specific applications are endless.The demand for copyright protection is also increasing.However,although Al for composing is diversified and its applications are widespread,the core and theory of AI are the same,that is,they are all based on in-depth learning in machine learning.For the copyright protection of artificial intelligence composing,the importance of studying the theoretical basis of related principles is self-evident,so the related theoretical basis of artificial intelligence is also involved in this paper.At the same time,the overseas research on artificial intelligence such as composer's artificial intelligence also has a good reference for us to study related fields.We can learn from the advanced experience of foreign countries to make up for the shortcomings,to seek profits and avoid disadvantages.It has a guiding and reference significance for us to study the copyright strategies of composer's artificial intelligence.This paper also has a reference for foreign related fields.This paper not only includes the theory and principle of composing AI,foreign related experience,but also the analysis and research of AI,as well as the path of copyright and legislative suggestions,which I believe will be helpful to the regulation of related fields in China.This article is divided into four parts,the following will tell.The first part is an overview of AI composing.This paper first describes the origin of AI,from its birth to its first rise,then its prosperity and decline,then its second rise,the impact of personal computers declined again,until the third rise of AI supported by big data,deep learning algorithms and the core of superpower in recent years.Overview of each stage.Then,the definition of artificial intelligence and composing is analyzed,and the current situation of composing artificial intelligence is described in detail and objectively.The first part of this paper makes a detailed analysis of the object of this study.The second part analyses the copyright of AI composers.Firstly,the rationality and necessity of copyright of AI composing are described in detail,and the dilemma of copyright of AI composing is also described.Then,the composing principle of AI composing is analyzed in detail.Then,AI composing is compared with music works on Copyright Law,the standards of works on Copyright Law are analyzed,and AI works are analyzed.The copyright constraints of cocoa and the potential solutions to the legal issues in this paper are obtained through comparative analysis.The third part,the analysis of foreign regulations on artificial intelligence creations.By studying the policies of the United States,the United Kingdom,Japan,the European Union and some international organizations on artificial intelligence creations,this paper makes a detailed analysis of the policies of this country in order to make up for the weaknesses of China's policy-making and avoid the disadvantages.The analysis of foreign studies is of great reference for the formulation of our system.Learning from the advanced experience of foreign countries is of great significance for us to study the copyright strategies of composer AI.The forth part,Selection of copyright protection path for AI composing and relevant legislative recommendations.Through the research on AI composing and the analysis of foreign experience,it is concluded that tool theory,public domain theory and electronic person theory are the three solutions to the copyright problems of AI composing.At the same time,the advantages and disadvantages of the three solutions are evaluated,which can be of some significance to decision makers.Moreover,the proposals of corresponding legislation can solve the legal problems arising from AI composing from various levels.
