Research On Children's Testimony Collection And Acceptance In Sexual Assault Cases

In recent years,the cases of sexual abuse is frequently exposed.The cases not only affects the healthy growth of children,but also is not conducive to family harmony and social stability.In sexual assaults cases,the children's testimony is different from the criminal suspect's affidavit.The "one-to-one" evidence affects the result of the case directly.Researching on children's statements has practical value and theoretical value,it carry out the zero tolerance policy,protects children's rights and promotes criminal justice.This article finds that the discovery rules are not detailed enough and the rules of admissibility are not targeted,based on analysis of the psychological characteristics of the children aged 2-12 years,such as express inaccurate,reasoning ability is weak and so on.Judicial practice have some problem,such as less female staffs take part in judicial practice,less synchronous audio and video during interrogation and a lack of separate analysis of children's testimony,which affect acceptance of evidence.We should solve those problem.So,we must adhering to certain basic principles that protecting children's privacy and asking the children one time.Also,standardizing professionally inquiry eyewitness system is important.Those measures will reduce the risk that the evidence are inaccuracy.Meanwhile,on the basis of reviewing our country's mode of proof,we finds the measures that comprehensively use various methods,improve the rate of child victims appearing in court and strengthening the judgment document's persuasiveness are effective.The above measures will solve the problem of children's testimony in sexual assaults cases,improve the quality of case handling and maximize the rights of children.
