Study On Main Problems Of Local People’s Congress In The Legislative Process

Local legislation process standardizes the guarantee related to citizens’ basic rights and interests,the development of local economy and the stability of social order or not.Since the reform and opening-up policy,China’s local legislation has got breakthrough progress.The amendment of Legislation Law of the People’s Republic of China(later referred to as Legislation Law)in 2015 is of great significance for perfection of local legislation process.We shall also realize many problems existing in local legislation process when looking back on the achievements.Main problems existing in the local legislation process are discussed in this paper.We need to specify the development process of a series of concepts and subjects when discussing main problems existing in the local legislation process.So we introduce the concept of local legislation,the development history of local legislation subject,and meaning of local legislation process,and its specific procedure in Chapter Ⅱ.Besides,we also discuss the significance of standardizing the local legislation process in the economic and social development and the guarantee of citizens’ basic rights and interests.Concepts are specified to lay a foundation for discussing the main problems existing in the local legislation process next.The public and the local National People’s Congress as the democracy basis of local legislation don’t give play to the expected role in the local legislation process.So we analyze the problems in specific link of the local legislation process which restrict their roles in the beginning of Chapter III.Later,we expound the improper intervention of local legislation process from other external force in order to maintain the "non-public interest" related to them.Those external forces are called as "local legislation protectionism".In addition to the above three problems,we also discuss the unnecessary repetition of local legislation due to insufficient local legislation talents and imperfect review mechanism in local legislation process.The above four problems are main ones in the local legislation process.We discuss problems in order to solve them well.We not only propose suggestions about solving the above four problems based on the national conditions and social development,but also provide enlightenment for China’s establishment and perfection of some systems by introducing the advanced experiences of western developed countries.State and citizens shall proactively participate in the perfection of the local legislation process.We shall jointly strive to standardize the local legislation process under the leadership of Party.
