On The Protection And Management Of Geographical Indications In China From The Particularity Of Interests

Geographical indications are signs indicating the origin of goods or services,which are usually formed by local producers under the unique geographical environment.They have historic and cultural heritage significance.By connecting the quality,reputation or characteristics of goods or services with the natural and human factors of the origin,it can increase the added value of goods or services,bring more benefits to producers,and provide consumers with more reliable quality information.China is powerful in geographical indication resources.Since its accession to the "Paris Convention" in 1985,China has started the protection of geographical indications.Three laws and regulations of geographical indications with Chinese characteristics have been gradually established by learning from the mature international geographical indication systems,which has promoted the development of geographical indications in China.However,due to the late start and the lack of sufficient running in with our basic national conditions,there are still many imperfections in China's geographical indication system.Especially the disunity of the standards and procedures of geographical indication identification,which have caused many problems in practice,damaged the relevant interests and affected the protection effect.This paper focuses on the particularity of interests of geographical indications,analyzes the current system of geographical indications in China,and reflects on the practice of "Zhenhu embroidery".This paper deeply analyzes the problems in rules design and practical application,and puts forward some suggestions,such as reconsidering the role of "Trademark Law" in the protection of geographical indications,establishing the protection law of geographical indications,well linking the old and new systems and arranging the vested interests.
