Research On Legal Issues Of Enterprise Annuity Trust Risk Control

With the reform of pension system in the world,enterprise annuity,as a key way to relieve the pressure of national basic pension,has become the focus of all countries in the world.The Enterprise Annuity is the main part of the national social security.The research and development of the enterprise annuity system have been carried out at home and abroad,and the legal system of enterprise annuity has been improved gradually.China's initial exploration in the field of annuity started relatively late in the early 19 th century.With the gradual popularization of the basic concept of annuity,it is clear that enterprise annuity takes trust as the main means of operation.Therefore,this article will take the annuity trust risk as the starting point,will explore in the risk control our country related legal system existence vacancy and the insufficiency,and will take this as the foundation,to the annuity trust risk control proposed the feasible legal proposal,this paper is divided into three parts:The first part is a preliminary study of the meaning and characteristics of "enterprise annuity trust",the analysis of the possible risks in the operation of Enterprise Annuity Trust,this paper discusses the necessity of risk control research from the aspects of security guarantee and legal system.The second part focuses on the theme of the paper,"the risk control of Enterprise Annuity Trust",on the basis of the existing regulations of enterprise annuity trust in our country,analyzes the legal problems and deficiencies of risk control,this paper points out the imperfection of legal control regulation in different kinds of risks,which is divided into procedure,credit,investment and beneficiary risk control.The third part lists and sorts out the current regulations about enterprise annuity trust in our country,and points out the relative legislative suggestions for the risk control in our country's annuity trust,by referring to foreign advanced annuity system and its risk control measures,combined with the current situation of China's development,it is proposed to strengthen the trustee status,strengthen the legal control of investment risk,strengthen credit supervision and risk compensation mechanism,through the establishment of the corresponding system one by one to carry out legal regulation.
