Research On The Legal System Of The Classified Supervision Of The Minors' Network Bad Information

In recent years,the Internet is becoming more and more important for minors.Internet has become an indispensable way of-life for minors in China.The network provides a huge knowledge base for minors,which makes the amount of information obtained by minors have a significant leap.However,the proliferation of a large number of bad information,such as violence,terror,pornography,false information,is not conducive to the healthy growth of minors.This paper hopes to provide some useful enlightenment for the improvement of the relevant regulatory legal system of our country through the research on the legal system of the classified supervision of the minors' network bad information.This paper is divided into four parts:The first part mainly analyzes the basic theory of the legal system of the classification supervision of the minors' network bad information.This paper defines the concept of classified supervision of minors' network bad information,points out the nature and characteristics of classified supervision,and analyzes the practical basis and significance of classified supervision of minors' network bad information.The second part mainly studies the achievements and deficiencies in the legal construction of the supervision of the minors' network bad information.First of all,this paper analyzes the practical exploration from promoting legislation to strengthening law enforcement,and then to encouraging industry self-discipline.Secondly,it summarizes the main achievements of the legal system construction in China in the form of charts.On this basis,find out the existing problems,including the system is not perfect,the management system is not perfect,the regulatory measures are not in place and the use of science and technology is not sufficient.Through the study of the above two parts,in the third part,the author puts forward the principles that should be followed by the legal system of classified supervision of the minors' network bad information.The principle of supervision according to law is the first principle.The principle of combination of government and people,the principle of reasonable classification and the principle of scientific and technological application are all important principles.In the fourth part,on the basis of following the basic principles,drawing on the experience of other countries and regions in the classification supervision of minors'network bad information,combining with the national conditions,the basic content of the classification supervision legal system of minors' network bad information is put forward.In the aspect of classification system,first of all,we should make special legislation on the supervision of minors' network bad information to provide legal basis for the establishment of the system;second,we should make clear the scope of network information classification;finally,we should make classification standards by the way of age segmentation and content classification on the basis of extensive consultation.In the aspect of supervision system,first of all,we should establish the competent department of network information grading supervision for minors,help the industry organizations to establish grading standards,supervise and guide the effective implementation of grading.Industry organizations shall be responsible for the establishment of network information classification standards in accordance with the law,and shall coordinate and cooperate with government regulatory agencies in supervision.The producers of network information content shall be self disciplined and graded according to law,and shall be graded and marked in a prominent position.The network information content service platform shall take measures such as restricting the release of information content that is not graded,filtered or labeled or improperly graded.Schools and families should take the responsibility of correctly guiding and educating minors,and adopt safe filtering technology to prevent minors from contacting bad information.In terms of regulatory measures,it is necessary to develop and promote filtering software,establish a network level database,and improve the reporting and objection procedures.In terms of regulatory responsibility,we should make clear the legal responsibilities of network information content producers and network information content service platforms,and effectively strengthen external supervision and internal control.
