Study On The Private Annotation Law Of The Qing Dynasty

The research results of the law of the Qing Dynasty were brilliant.Private Annotation Law was unprecedentedly developed in the Qing Dynasty.The phenomenon of private annotation law was very active.Annotators have relied on years of experience in judicial adjudication work,devoting their painstaking efforts to annotating laws and creating brilliant achievements in annotating law in the Qing Dynasty.This article intends to take the private annotation law of the Qing Dynasty as the visual field,through in-depth understanding of the development process and prosperous reasons of this group,in order to explore the development and changes of the annotation law of the Qing Dynasty under the impetus of the private annotation law,from which to glimpse the implication of the annotation law of the Qing Dynasty Spiritual connotation,legal culture and its limitations.This article is mainly divided into the following parts: The first part mainly elaborates the historical background and general situation of the private annotation law,sort out the development process of the private annotation law in the Qing Dynasty,private annotation law developed on the basis of inheriting the legal ideology and culture of the Ming Dynasty,the discussion of private annotation law in the Qing Dynasty was initiated.The second part is mainly to explore the reasons for the prevalence of private law annotation.One is to analyze the inheritance of the legal culture in the Ming Dynasty,the other is the practical function of annotation law is required by judicial practice,and the third is to unify the application of laws in order to coordinate complex legal relations in the Qing Dynasty,fourth,the attention of the rulers and the growth of the discipline team.In the third part,the author analyzes the content and development of private law in a more comprehensive way by sorting out the schools of annotation and their representative achievements,summarizing the methods and characteristics of private annotation.The fourth part analyzes the relationship between private annotation and the official from the perspective of legal culture,summarizes the impact of the private law of the Qing Dynasty.The private law not only enriches the content of the law of the Qing Dynasty,makes up for the deficiency of the official law of the government,but also has a certain impact on the legislation and judicial practice.In terms of legislation,introducing private law into the law,amending the legislation,and also having a certainimpact on judicial practice,some well-known private notes have become the basis for the conclusion of cases,and efficient resolution of judicial disputes,and discusses the significance of private annotation in the Qing Dynasty.By analyzing the gain and losss of private annotation law,borrowing from the past and present,the wisdom of legal interpretation summarized by the ancients still has a very important reference value for us today.
