The Prevetion Of Duty Crime Of Railway System Based On Investigation Of Typical Cases

This study is an investigation on the problem of job-related crime in railway system in recent years,starting with 90 typical cases to analyze the current situation of job-related crime in railway system,this paper further analyzes the characteristics of duty crime in the railway system and the subjective and objective reasons,and attempts to explore how to reduce the occurrence of duty crime in the railway system from both legal and institutional aspects.On the basis of the data collection,collation and analysis made in the earlier period,and based on the current situation of the rapid development of China's railway industry,the problem of job-related crimes has arisen,firstly,from the general distribution,type distribution,the distribution of departments involved,the age of the persons involved and the general situation of the administrative level of duty crime cases in the railway system in recent years,this paper sums up the characteristics and harm degree of duty crime in railway system,and then sums up the subjective and objective reasons according to the present situation of duty crime in railway system and the interview data.Finally,according to the reasons for the formation of duty crime in the railway system,this paper puts forward some pertinent suggestions from the concrete measures of building an honest and clean government in the railway system.It is found that the field of railway engineering construction and the field of railway transportation management are the areas of high incidence of job-related crimes in railway system.Especially in the field of railway engineering construction,under the background of the rapid development of the railway economy and the continuous increase of railway investment,the crime in this field has shown an upward trend year by year,and some persons involved in the case,although of low rank,however,as a directmanager of public resources allocation,the opportunity to commit crimes is relatively high,"petty official corruption" phenomenon.The reasons include not only a series of system defects,lack of supervision and management loopholes,but also the quality of railway officials themselves.Therefore,in view of these reasons,this paper holds that the first measure to curb railway crime by taking advantage of duty is to perfect the construction of railway law and regulation system,to perfect the supervision system and the prevention system,and to increase the punishment,especially in the field of high incidence of cases,should be taken as the focus of prevention of crime by taking advantage of duty.In addition,improving the quality of railway civil servants is also an essential measure.
