Research On Methods Of Judicial Social Investigation Of Juveniles Involved In Crime

Judicial social investigation of juveniles involved in crime is an important reference for the individual treatment of juveniles in the process of handling criminal cases.No matter the laws,judicial interpretations issued at the national level,regulatory documents issued by various localities,and related judicial practices,it can be seen that social investigations are increasingly valued by judicial authorities in various regions.Whether the results of social investigation are objective,comprehensive and authoritative,whether it has reference value in dealing with juvenile cases involving crime,and whether it is helpful in juvenile's view of protection and education,largely depends on whether professional judicial social investigation methods are applied in a standardized and scientific way.However,since the system started late in our country,the legal provisions are too principled and lack of unified standards of judicial social investigation methods.However,scientific social investigation methods are indispensable for conducting a judicial social investigation.Based on this,this paper intends to study the methods of judicial social investigation of juvenile involved in crime.On the one hand,the study is around the knowledge system of the methods of judicial social investigation and the development of the methods of judicial social investigation;on the other hand,combining with the work contents and emphases of different stages of the judicial procedure of the juveniles involved in crime,this paper makes a practical study on the application of different judicial social investigation methods.This paper is divided into five parts in content:The first part is the introduction,including the research background of the judicial social investigation method of criminal juveniles,the meaning and value of the judicial social investigation method of criminal juveniles,and the necessity and importance of studying the judicial social investigation method of criminal juveniles.The second part is the research on the knowledge system of judicial social investigation methods,including the methodology of social science research,the quantitative,qualitative and evaluation methods of judicial social investigation methods,as well as the writing methods of investigation reports.The third part introduces the current situation of the development of the judicial social investigation methods of the juveniles involved in crime in our country,and points out that there are some problems in the judicial social investigation methods of our country,such as unbalanced development between regions,simple and rough investigation methods,and nonstandard investigation methods,which directly affect the quality of the judicial social investigation.The fourth part introduces the methods of judicial social investigation in the United States,Germany and Japan,and puts forward some references.The fifth part,according to the function of judicial social investigation in different litigation stages,the main investigation methods used in different stages is summarized.In the investigation stage,the basic situation of the juvenile involved in crime should be preliminarily understood and the structural interview method should be mainly adopted;in the review and prosecution stage,the social investigation is deeper than that in the investigation stage,the unstructured interview method and the participant observation method should be mainly adopted;In the trial stage,the time is relatively abundant,so it is necessary to carefully verify the relevant information of the juveniles involved in the crime,primarily adopting the unstructured interview method and the participant observation method;in the community correction stage,the judicial and social investigation of the juveniles involved in the crime is divided into three stages: before the community correction,under the community correction and before leaving the community correction,the participant observation method and the structured interview method should be mainly adopted.At the same time,according to the focus of social investigation in different stages of litigation,a social investigation evaluation scale is developed in each stage,expecting to provide reference for the practice of judicial social investigation of juveniles involved in crime.
