Study On The Improvement Of Public Security Detention System In The Perspective Of Personal Freedom

As one of the important contents of police administrative power,the right of public security detention is closely related to the protection of citizens' personal freedom.However,due to the lag of legislation,the anomie of public security detention right is very prominent in practice.With the improvement of people's right consciousness,the public's expectation and demand for freedom and right are more urgent and stronger than ever.The perfection of public security detention needs the attention of legislators.It is a pity that the "law of the People's Republic of China on punishment for Public Security Administration(Revised Draft for public opinions)" released by the Ministry of public security on January 16,2017 did not mention the amendment proposal on public security detention.Therefore,the author takes this opportunity to improve the system of public security detention,in order to better meet the needs of the development of the times.From the perspective of protecting personal freedom,this paper analyzes the perfection of public security detention system.This paper is divided into six parts,the first part is the introduction,mainly introduces the source of the topic,research significance,literature review and research methods,through these contents,we can roughly grasp the main content of this paper;the second part is the definition of the concept of public security detention,which compares the differences between public security detention and related concepts,in order to better understand the characteristics of public security detention;the second part is the concept of public security detention The third part is the development process and current situation of public security detention system.This part introduces the historical evolution of public security detention before and after the founding of new China and the current operation of the system.Grasping the law of historical development has a certain reference significance for the current legislative research;the fourth part is the analysis of the main problems of public security detention in China.This part combines with the current legislative situation and practical cases,respectively from the legislative and operational aspects of the problem;the fifth part is the theoretical basis and guiding principles of public security detention system to improve,which is the deepening of the theoretical research on public security detention,laying a theoretical foundation for the following suggestions;the sixth part is the improvement of the public security detention system,this part corresponds to public security detention This paper puts forward feasible suggestions on the legislation and operation mechanism of public security detention system.
