Research On The Enforcement Of Public Security Detention

The rule of administrative law is the embodiment of the rule of law in the administrative field,and is an important part of the construction of the rule of law in China.As a punishment measure of restricting citizens’ personal freedom,public security detention is closely related to the protection of citizens’ personal freedom.As the most severe punishment in administrative punishment,it should be strictly regulated by law.This paper studies the legal principle and system of public security detention execution,which has important theoretical and practical significance for promoting the construction of administrative rule of law in China.In the new era of China’s economic and social development,there are many new situations and problems in the execution of public security detention,such as the new challenges of the implementation of public security detention in the burst of COVID-19.Based on the perspective of the protection of civil rights,this paper studies the concept and value orientation of the rule of law in the implementation of public security detention,summarizes the experience and lessons in the practice of law enforcement by public security organs,and puts forward some suggestions on the improvement of the legal provisions and the implementation procedure system of public security detention,which will be of positive significance to the theoretical innovation and practical promotion of the construction of administrative rule of law in China.This paper is divided into four parts: the first part is the introduction,which first explains the research value and significance of this paper,then briefly analyzes the research status at home and abroad,and finally demonstrates the research methods,difficulties and innovation points of this paper,hoping to respond to the research topic of this paper through these elaboration;the second part introduces the basic theory of public security detention execution,through the comparative study Security detention and other detention in the implementation of the difference,a better explanation of the characteristics of the implementation of security detention,for the following problems and Countermeasures to lay the foundation;the third part describes the main problems existing in the implementation of security detention of public security organs,combined with the current legislative situation and research cases,in-depth analysis of the current problems,the implementation of security detention practice of theoretical summary Knot.The fourth part puts forward countermeasures and suggestions.This part explains the basic principles of the implementation of public security detention,summarizes that the implementation of public security detention,as an important part of the administrative rule of law,and the possible infringement on citizens’ personal freedom,strictly stipulates the subject and procedure of the implementation of public security detention,realizes the unity of administrative efficiency and administrative fairness,and reflects the value pursuit of administrative rule of law in the practice of administrative law enforcement.
