Research On Online Virtual Assets Inheritance System

With the wide application of Internet technology in the society,in recent years,the inheritance disputes about network virtual property in China are frequently increasing,so it is urgent to regulate it according to law.It is fitted in Chinese General Civil Law that virtual property is the object of civil rights,but it is not defined as the object of real rights.However,property rights of Public cannot be protect because of lack of regulation in cases of succession.Our country need a set of network virtual assets succession system which based on China General Provision of Civil Law and Inheritance Law from theory to procedure urgently.Only in this way,the citizen's property rights and interests can be protect and a healthy and harmonious Internet environment can be built by encouraging creation and making good use of Internet resources.In the theory field,this article refers that network virtual assets are property rights and builds the network virtual assets succession system working with true cases.First of all,the introduction part of the article elaborated the purpose and significance of the paper,comprehensively analyzed the theoretical research status at home and abroad and briefly summarized the main content of the article.Secondly,the second part of the paper defines the basic concepts and legal attributes.It is argued that the network virtual property has the property right attribute and can become the object of inheritance.According to the special nature of network virtual property,a new classification standard is proposed.Eventually,the inheritability of network virtual property is clarified,which provides a theoretical basis for the perfection of network virtual property inheritance system.Thirdly,the third part of the paper puts forward the main problems of constructing the network virtual property inheritance system in China.By analyzing the case,this paper illustrates the problems of virtual property inheritance in practice from these aspects: lack of legal basis,difficulty of subject proof,difficulty of object value evaluation,negative attitude of operators and special inheritance procedure.Finally,the fourth part of the article from the legislative model,the subject of inheritance,the object of inheritance,the way of inheritance and the procedure of inheritance and other aspects of specific and feasible Suggestions.It provides a new idea to solve the difficulty of perfecting the network virtual property inheritance system proposed in the third part.
