An Analysis Of The Inheritance Of Virtual Property In The Network

With the comprehensive popularization of the network and the continuous change of information technology,the Internet brings more convenience to people,at the same time,related legal issues also emerge one after another.In recent years,the protection of network virtual property is one of the more representative issues.Article 127 of the general principles of the civil law of the People's Republic of China(hereinafter referred to as the general principles of the civil law)in 2017 stipulates that “if the law has provisions on the protection of data and network virtual property,they shall be in accordance with the provisions of the law”,This marks the first time that the network virtual property is included in the scope of protection by the law of our country,and takes a strong first step to solve the problem of network virtual property protection.However,the details of the protection of network virtual property are not covered in our legislation,so in theory and judicial practice,there are still a series of problems,such as the legal attribute is difficult to be divided,the ownership of rights is difficult to be determined,and the inheritance rules are difficult to be clear.Based on the analysis of the legal attributes of the network virtual property and the necessity of inheritance,this paper analyzes the problems of the inheritance system of the network virtual property in China through specific cases,and draws inspiration from the relevant foreign laws and regulations,some reasonable suggestions are put forward,such as determining the subject and object of network virtual property inheritance,building personal virtual property information system,making clear the ownership of virtual property without inheritance,introducing the third-party evaluation organization to conduct value evaluation and solving the conflict between privacy and inheritance rights,so as to improve the system of network virtual property inheritance in China.
