On The Legal Protection Of Laborers' Working Environment Rights

At present,the protection of workers' working environment rights in China is not comprehensive.Occupational diseases and industrial accidents have occurred from time to time.Even some infringed laborers have taken extreme measures to safeguard their legitimate rights and interests because of lack of relief.Such incidents occur for Chinese workers.The legal protection of environmental rights has sounded the alarm.Therefore,it is particularly important to explore the legal protection of workers' working environment rights.Although China has promulgated many laws such as the Labor Law and the Safe Production Law,in order to safeguard the working environment of laborers,the existing laws still have problems such as unclear legislative objectives,weak law enforcement,and lack of relief channels.Western developed countries have first realized the importance of workers' work environment rights,or adopted comprehensive occupational safety and health legislation,or developed the right to work environment on the basis of labor safety and health rights.They have achieved satisfactory results.The state's advanced system experience,improve the legal protection of the working environment rights of Chinese workers,so that workers have a decent,healthy and safe working environment.The thesis consists of five parts,as follows:The first part is the introduction.This paper briefly describes the research background of this paper,and leads to the significance of this study.Through sorting out and analyzing a large number of documents,it summarizes the research status at home and abroad,so as to understand the research results on the right to work environment,and open up ideas for this study.The second part: overview of the right of working environment.Firstly,it defines the connotation of the right to work environment,including the concept,nature and basic content;secondly,it analyzes the right to work environment and the right to occupational safety,and better combs the differences between them;finally,it demonstrates the theoretical basis of the right to work environment from the theory of the right to exist,the right to health and the theory of corporate social responsibility.The third part: the introduction and Enlightenment of the protection system of the right to work environment for the workers outside the country.This part introduces the legal protection system of the right to work environment in the United States,Sweden and the United Kingdom in detail,and summarizes the enlightenment to the legal protection of the right to work environment in China from three aspects: making a unified law,setting up a unified supervision organization,and emphasizing employees' participation in the safety and health matters of enterprises.The fourth part: the problems existing in the legal protection of the right of working environment of workers in China.Based on the current situation of the protection of theright of working environment in China,this paper analyzes the problems from three aspects:legislation,law enforcement and relief mechanism.The fifth part: improve the protection path of the right of working environment.The specific path is to strengthen the legislative system construction of the right to work environment,establish a unified and perfect law enforcement supervision agency,and improve the legal protection and relief procedures of the right to work environment.
