A Study On The Supervision System Of Civil Prosecution Of False Litigation

In the background of increasingly complex social relations,civil false litigation is also common.This lawsuit phenomenon improperly occupies and consumes limited judicial resources,which makes the way of judicial dispute resolution more congested.Moreover,this kind of lawsuit seriously infringes on the legitimate rights and interests of other people and social public interests,tramples on the lawful right of action entrusted to citizens by law,impacts on the normal litigation order,challenges the principle of good faith,and damages the judicial authority and credibility of our country.The judicial order belongs to a part of the public order,and the procuratorial organ,as the state's legal supervision organ and the protector of the public interest,should do something.First of all,it introduces the different disputes of the definition of false litigation,discusses what is false litigation through comparison,and analyzes the common types and causes of false litigation.This paper analyzes the limitations of the court as the main body of the traditional prevention and control in regulating the false litigation,and then leads to the important significance of the procuratorial organ's intervention in the regulation of the false litigation.Secondly,it discusses the basis of the procuratorial organ's intervention in the regulation of false litigation theory and law.Thirdly,it analyzes the effectiveness of the supervision of the procuratorial organ on the false litigation,and puts forward the existing problems of the civil procuratorial supervision of the false litigation and the reasons for the difficulties.Finally,puts forward some suggestions on the legislation and judicature of regulating the false litigation.
