Research On Privacy Policy In Mobile Application

The principle of informed consent is one of the important principles of personal information protection in today's era,and it is widely recognized and adopted by personal information legislators around the world.Because of its simplicity,inexpensive,and natural compliance with regulatory requirements,online privacy policy have gradually become the main manifestation of the principle of informed consent since the end of the 20 th century,and have played a good role in protecting personal information.When mobile applications(Apps)have made the connection between personal information and cyberspace ever closer,the subtle problems that originally existed in privacy policy have been magnified unprecedentedly.The user may therefore be essentially forced to agree to the privacy policy in the mobile application,regardless of whether the content therein will adversely affect the rights and interests of personal information.Although scholars in some countries and regions have recognized this problem,they still fail to solve the problem of forced consent of users in various practices.Therefore,it is necessary to examine the relevant theories of the principle of informed consent,comprehensively analyze the core issues in the governance and supervision of privacy policy,and respond to the issue of users' mandatory consent.This article is organized into five chapters.The first chapter is the introduction,which mainly introduces the research background,research status,research purpose and innovation of this article.The second chapter is an introduction,which mainly discusses the basic concepts of privacy policy,sorts out the development context of privacy policy,and clarifies the basic relationship between privacy policy and the principle of informed consent,the right to self-determination of personal information,and the right to privacy.The third chapter is the construction and dilemma of the privacy policy.It starts with the dilemma of the informed consent principle in the current network environment,and analyzes the governance needs of the privacy policy in the current context and the problems in existing governance practices and put forward the root cause of the user's forced consent.In Chapter 4,the review of the governance foundation of privacy policy,this paper discusses the review and amendment of the governance framework logic from governance thinking to governance norms with theories of private power theory,network platform theory,and personal information protection scenarios,in order to seek users' selects right in privacy policy.Chapter 5 proposes specific governance methods and supervisory countermeasures based on the results of the review and revision of the governance framework.
