In recent ten years,the popularity of applying for civil servants has increased,and the large number of people preparing for the exam is accompanied by people's higher expectations of fairness and efficiency of the civil service employment system.As a special embodiment of the administrative legal relation in the field of job hunting and recruitment,the civil service employment system should be recognized and controlled from the perspective of academic theory and norms.Therefore,around the ascend system "fairness" and "efficiency" the basic purpose of this article from the system development,system analysis,operation analysis,comparison analysis,respectively,to carry out,such as Angle in the existing system of the basic principle and application form after fully cognition,respectively from the angles of system design and system running,the system of defective or to improve link analysis,and gives corresponding perfecting suggestion.In this paper,the research on the civil service recruitment system is limited to the selection of civil servants.On the premise of this,the employment activity involved in this paper is essentially an administrative act in which the recruiting organ as the administrative subject exerts an influence on the relevant rights and obligations of the examinee as the administrative counterpart.Therefore,it is necessary to clearly define the legal nature of each employment behavior of administrative subject and the legal rights of administrative counterpart to ensure the effective operation of administrative behavior under the restriction of legality.In the operation of the employment system level,the absence of fairness mainly comes from the lack of procedural justice-the program design is not limited by subjective involvement of administrative subject appropriate space,not through the institutional controls the administrative main body beneath the subjective motive and the subjective consciousness of fairness from the employment standards.Based on the in-depth analysis of the two representative phenomena of "administrative discretion" and "employment discrimination" in the employment system,it is concluded that the fundamental pursuit of procedural justice is to regulate substantive rationality with formal rationality.Through the analysis of the employment system of civil servants in Britain,Russia and South Korea,this paper combines with the understanding of the legal norms,recruitment announcements and typical cases of the employment system of civil servants in many regions of China.It is not difficult to find that China's civil service employment system in the "examinee rights","relief channels","investigation form","internal and external supervision" and other aspects of the provisions still exist a large omission.So the article finally from the "system construction","legal norms","supervision work","operation efficiency" four aspects to improve our country's civil service employment system to give reasonable Suggestions.
