As an important cultural heritage in our country,folk literature and art works based on it have also received much attention.Since the 19 th party put forward the point of view that add the development of traditional culture into the cultural construction in the brand new era,the legal protection of the folk literature and the art works has gradually become the warm spot of intellectual property research in China,but there are still no universally accepted system of legal protection has yet been developed.The present age is an era of increasing globalization and rapid development of information technology,which has intensified the commercial development of folk literature and art works.Developed countries have used the knowledge from developing countries for free on the ground of "entering the public domain",and the results obtained have then relied on the intellectual property system to re-enter the developing countries,gradually losing respect for the group of people who inherit works of folk literature and art,driven by interests.And bring impact to the culture of the country of origin.If the rich-contain literary and artistic works are related to money and interests,coupled with excessive commercial use and large-scale adaptation,it will lead them into improper use and even damage distortion in large degree.From this point of view,protecting them through legal means is an effective way for Chinese civilization to inherit,develop and continue.It is an important content for building socialist spiritual civilization and an important measure for making the Chinese dream come true.Therefore,it is particularly important to correctly understand the connotation and characteristics of folk literature and art works,find out the legislative defects,and meanwhile explore a more complete legal protection path.This article intends to expound the concept and characteristics of folklore works,analyze the current situation and many existing problems of the protection of folklore works,and through the idea of protecting them,provide reference for the construction of the legal protection system of folk literature and art works.Promote the perfection and strengthening of the protection of reality and enrich the content of the protection of folk literature and art works at this stage.This article consists of five parts.The first part of the article is a brief introduction that expound the background and content of this research also includes the analysis of the necessity of the research.The second part is to elaborate the path selection of folk literature and art works by countries and organizations around the world and the current situation of domestic path selection,and find the dilemma faced by domestic legislative protection through learning from experience and self-examination.The third part is thinking about the protection path of folk literature and art works.The fourth part is to put forward the author’s point of view on the choice of protection path,and try to put forward solutions or measures to improve the legal protection system.The fifth part is the summary and expectation of the whole paper.
