Research On Unilateral Civil Legal Act

The promulgation and implementation of the "General Principles of the Civil Law of the People's Republic of China"(hereinafter referred to as the "General Rules of the Civil Law")is undoubtedly a milestone in the modernization of the socialist legal system with Chinese characteristics.Since its official implementation on October 1,2017,the "General Principles of the Civil Law" have not only substantially opened The pace of enactment of the Civil Code has guided the construction of our civil law ideology,and has also effectively protected the rights of civil subjects of all parties.At the same time,the promulgation and implementation of the "General Principles of Civil Law" also provide a theoretical direction and theoretical basis for the study of unilateral civil legal acts in China.This article will analyze and study unilateral civil legal acts in China from the following five aspects: The first part mainly introduces the definition of unilateral civil legal acts and their differences from related concepts.This chapter provides a macro analysis of unilateral civil legal acts from the perspective of legal theory.It is also the basis and premise of the discussion in this article;the second part is an introduction to the current applicable model of unilateral civil legal acts in China,mainly including contract model,debt model and private law autonomy model;the third part mainly expounds the establishment requirements and Effectiveness requirements,due to the particularity of unilateral civil legal acts,some unilateral civil legal acts are effective when they are established,and sometimes only take effect when conditions are fulfilled;Part IV introduces the significance and deficiencies of unilateral civil legal acts in the General Rules of Civil Law Therefore,this part will focus on the analysis,and explore the highlights and deficiencies of the unilateral civil legal acts,to pave the way for the following suggestions;Part V is aimed at the deficiencies of the current unilateral civil legal acts in China Put forward relevant suggestions for improvement.In this way,this article hopes that with the help of research and analysis of current unilateral civil legal acts in China,with a view to perfecting the normative system of unilateral civil legal acts in our civil code,Under everyone's expectations,the Civil Code was promulgated on May 28,2020,and entered into force on January 1,2021.
