With the rapid development of China's economy over the years,the transportation field has also made considerable progress compared to before.Traffic safety issues have become increasingly prominent.Among them,Although China's current laws make clear provisions on this issue,many details have not been finally resolved.Such as: the main body of the traffic accident infringement is only expressed as "the motor vehicle",but it does not specify the specific classification of various specific situations such as age and capacity,etc.;the constituent elements of the traffic accident infringement have not given specific according to the clear regulations;the remedies for the damage caused by the traffic accident infringement can not find specific and detailed legal expressions,etc.This paper use of cost-benefit analysis,game theory and other basic theories of law and economics,in-depth discussion and research on the above issues.This study divides the cost of traffic accidents into six main categories based on their subjective and objective causes,including accident damage costs,litigation costs,time costs,health costs,environmental costs,and administrative costs.Taking a traffic accident in Laoshan District,Qingdao as an example,the detailed performance of various costs of traffic accidents is described in detail.At the same time,the basic theory of law and economics is used to analyze it,so that the abstract theory has a concrete and intuitive expression.Finally,based on the basic theories of costbenefit analysis and game theory of law and economics,combined with the mathematical model of traffic accident costs and related economic theories,personal suggestions are given for the refinement and improvement of China's transportation laws and regulations.In order to provide theoretical reference for China's traffic safety related legislation and justice and provide new ideas and directions for subsequent related research.
