Research On The Legal Status Of The Administration Committee Of The Development Zone In China

Thanks to the opportunities brought by reform and opening up,development zones have been burgeoning in China.As reform and opening up moves forward,development zones have more in-depth impacts on China's level of economic development.At this stage,development zones have contributed greatly to China's economic system reform,industrial structure upgrade,employment rate rise,urbanization advancement,and urban-rural gap reduction.Such a big contribution is impossible without the all-round management of the development zone by the administration committee of the development zone.The administration committee of the development zone manages China's development zones.However,the legal status of the administration committee of the development zone has not been uniformly stipulated.The author summarizes two aspects concerning the legal status of the administration committee of the development zone: theory evaluation and legislation analysis.In terms of theory evaluation,the author summarizes the legal status of the administration committee of the development zone as a first-level local government,the detached agency of local people's government,the detached office of local people's government,an organization that is authorized by laws and regulations,and an administratively entrusted organization.Moreover,a comparison is made between the above statement and local government statement,detached agency statement,detached office statement,laws and regulations authorization statement and the administratively entrusted organization statement.It follows that defining the legal status of the administration committee of the development zone as a detached agency of the first-level government is consistent with the detached agency statement.As for practical analysis,by sorting out and summarizing the development zone regulations and local work documents including local laws and regulations and local government regulations,etc.,it is concluded that the legislative tendency is to define the legal status of the administration committee of the development zone as the detached office and the detached agency of the first-level government.Furthermore,in practical analysis,practical issues such as unclear functions and extent of power,nonstandard organization settings,and unclear administrative violation responsibilities caused by the defining of the legal status of the administration committee of the development zone are also discussed.The author defines the legal status of the administration committee of the development zone from theoretical and practical aspects.Theoretically,through analysis and comparison,the author concludes that the legal status of the administration committee of the development zone should be defined as the detached agency of the first-level government.Practically,through analysis and demonstration,the author concludes that the legal status of the administration committee of the development zone is the detached agency of the first-level government.The author then divides the operation improvement of the administration committee of the development zone as a detached agency as two aspects: legislative improvement and specific operational improvement,and proposes solutions to the practical problems caused by the legal status of the administration committee of the development zone.
