Research On Intellectual Property Protection Of China's TV Program Mode

The TV program mode plays an indispensable role in TV program production.It not only has the functional characteristics of program production guidelines,but also reflects the intellectual resources and cultural heritage of the creator because of its unique combination of elements and detailed design.Determines the maturity and production level of a TV show.The development of China's television production industry started relatively late.When the television program model has been launched in the international industry market,the country is still at the stage of purchasing complete television programs from outside the country.Until 2010,Shanghai Oriental TV purchased the British variety show "Britain's Got Talent",and after localization and transformation,produced "China Talent Show",after the program was broadcast,the viewing effect and the commercial value created As a result,the domestic TV industry quickly saw the potential economic benefits of the TV program model transaction.Therefore,foreign TV program models were purchased in large quantities in the country.Various popular variety shows such as "China Good Voice" and "Running Brothers" have appeared in China On the screen,the TV program market is increasingly prosperous.However,at the same time as the globalization of the TV program model transactions,various infringement disputes have followed.A large number of plagiarism and clone programs have sprung up in the domestic television industry,and the creators of TV program models and purchasers of TV program models have embarked on the road to defending their rights.However,due to the lack of a unified definition of the television program model by law,the theoretical circles also have different views on the protection of the copyright law of the television program model.The protection of the rights and interests of the television program model is difficult,plagues rights defenders and judicial judges,and hinders television.The healthy development of the industry:On the one hand,as China 's main importer of TV program models,a large number of foreign TV program models have been copied and imitated.Even if infringement disputes are usually left behind due to the lack of a legal system,the international reputation of the domestic TV industry will be greatly reduced;On the other hand,as a country with deep cultural heritage,China should also actively innovate independently,create more high-quality television program models,and promote the export of the cultural industry.However,if a comprehensive rights protection mechanism has not been established,domestic creators will consider based on their own interests.It will also reduce their enthusiasm for creation.Based on the comparative analysis and case analysis methods,this paper attempts to propose a three-dimensional and multi-angle intellectual property protection strategy based on the complex multi-element combination of TV program mode based on the summary conclusions,and strives to reverse people's TV.The one-sided concept of the mode of the program has made people pay attention to the protection of the TV program mode.In order to make China's TV industry develop healthily,it is necessary to establish an effective legal protection mechanism for TV program models.Based on the analysis of the concept and basic characteristics of the TV program mode,this article attempts to discuss the legitimacy of the subject of copyright law protection in combination with domestic and foreign theoretical and judicial practice research.The unfair competition law is a supplement to the protection mechanism of the television program model.
