With the rapid development of e-commerce in the era of big data,B2 C e-commerce platforms rely on their own resource advantages to mine valuable consumer information for their use in order to obtain greater profits and occupy market competitive advantages.However,the big data “killing ripe” implemented by some platforms for abusing data rights in order to obtain excessive profits has also received continuous attention from all walks of life.Algorithm analysis technology provides support for B2 C e-commerce platforms to implement big data "killing ripe",increasing the asymmetry and opacity of online transactions,resulting in this behavior not only disrupting the online trading environment,but also seriously violating consumers' knowledge Legal rights such as rights and fair trading rights seriously deviate from the basic principle of good faith in the field of civil activities.Therefore,the "killing ripe" of big data has become an urgent problem to be solved in the development of e-commerce.This article aims to clarify and define the behavior of implementing big data "killing ripe" on B2 C e-commerce platforms,and puts forward suggestions for the harm of consumer rights behind it and how to effectively regulate the application of algorithm technology in the field of e-commerce.The full text is divided into five parts,the contents are as follows:The first part mainly summarizes the views of some scholars at home and abroad based on the background and current status of the current big data "killing ripe",and forms a literature review.The second part starts with the concept of big data "killing ripe",analyzes the relationship between big data "killing ripe" and price discrimination,and lists the main forms of big data "killing ripe".Furthermore,by combing the technical path of implementing big data "killing ripe" on the e-commerce platform,the reason and essence of implementing big data "killing ripe" on the B2 C e-commerce platform are revealed.The e-commerce platform uses big data analysis technology and other means to grab all the consumer surplus to maximize the benefits of the platform.The infringement of consumers' rights is only the appearance and result of big data "killing ripe".The essence and root of big data "killing" is that the power of algorithms is abused by operators.The third part mainly analyzes the current governance dilemma of big data in China from three aspects.One is the inadequacy of relevant laws and regulations: With the development of big data technology,China's "Price Law" and "Antitrust Law" Etc.can no longer be fully applied to the phenomenon of price violations such as big data "killing ripe",which needs to be improved and modified to overcome the dilemma of applying the current law.The second is the lack of legal governance of algorithm technology.From the root point of view,big data "killing ripe" is not simply a matter of legal regulation,but also needs to strengthen the governance of algorithmic power.At present,there is a huge gap in the establishment of algorithm supervision departments and algorithm supervision measures in China.Only by strengthening the governance of algorithm power can we better cope with the phenomenon of big data "killing ripe".The third is the lack of industry governance.At present,the overall credibility of China's society is low,and industry alliances and associations have not played an active role in guiding and supervising,which has contributed to the illegal activities of e-commerce platforms that violate integrity and morality.The fourth part is based on the analysis of the reasons summarized in the previous part,and puts forward some self-improvement suggestions for big data "killing ripe",mainly by improving the components of price discrimination,introducing a public interest litigation mechanism for big data "killing ripe",and designating special Supervisory agencies and the establishment of sound algorithmic supervision measures,strengthening industry self-regulation,and improving consumer awareness of prevention and rights protection,and other major response mechanisms to curb the phenomenon of B2 C e-commerce platform big data "killing".
