The emergence of big data technology has changed the decision-making mechanism,business model and competition mechanism in many fields,which not only brings convenience to the society,but also brings some side effects.The development of big data technology,on the one hand,can provide consumers with richer and more personalized products or services,reduce the time or money cost for consumers to find goods,tap consumers’ potential demands,and improve their satisfaction for products or services.On the other hand,algorithm which based on large data can accurately estimate consumers’ preferences and willingness,thereby infringing lawful rights and interests of consumers.And it can also disturb the competing order of market,thus increasing monopoly phenomenon.User’s personal data information may have been collected by induce or excess way,then resold in illegal way.This act can violation user’s privacy rights and interests.The purpose of this paper is to make Suggestions for improving relevant laws to protecting consumers’ rights and interests、users’ privacy rights、personal data rights and market competition order.This paper is divided into four parts.The first part expounds the concepts of price discrimination in traditional economics and in the environment of big data,as well as their relations and differences.And proposes the legal basis for the legislative regulation of price discrimination on Internet platforms.The second part expounds the current situation and problems of legislation and regulation of price discrimination on Internet platform.The third part expounds the legislation and regulation of price discrimination on Internet platform in the European Union and the United States,so as to draw the enlightenment of legislation and regulation on relevant issues in China.On the basis of the preparation of the first three parts,the fourth part puts forward Suggestions from the perspectives of the anti-monopoly law,the price law,the consumerrights and interests protection law and the personal information protection law.
