Joint punishment for dishonesty is a credit guarantee system which combines the governments,the judiciary and all social parties to take credit disciplinary measures in accordance with the law against dishonest subjects.Joint punishment for dishonesty increases the cost of breaking the promise,then it could supervise and urge people to fulfill their responsibilities as soon as possible,and it could also warn others that they should keep their promises.At present,the legal basis for the enforcement of joint disciplinary actions for dishonesty is mainly the regulations of departments of the State Council,local regulations and other normative documents,what's more,all localities and departments have not only the common actions but also their own characteristics in the areas of information collection and release,disciplinary measures taken,credit restoration and judicial relief of the parties.There is no doubt that it provides a reference paradigm and experience for the perfection of the national joint disciplinary system.However,because of the inconsistency of applicable scope,applicable standard,implementation procedure and other elements,the hidden trouble is also buried for the fragmentation of information,the inconsistency of standards,the increase of disputes and so on.By perfecting the legal system,reasonably allocating the scope of the powers of the implementers in the joint disciplinary system for dishonesty,standardizing their power implementation methods and procedures,and affirming the credit restoration rights of the credit subjects and the related judicial relief rights,it is beneficial to improve the anticipation of the possible consequences of the credit subject's behavior,and to obtain the balance between the credit supervision authority's rights and the protection of the credit subject's rights.
